That will actually not fail the California smog inspection. There is no thermostatic air cleaner on this year. So no fail. On 96 and newer the inspectors don't even put a sniffer in the tailpipe, they plug into the PCM and make sure there are no trouble codes and see if the monitors have been set.

I know a referee. That intake has been modified from stock. From what I understand, if any part of the stock intake is removed, it's an automatic visual fail. Not all shops will fail it, but I know the ref would. I actually need to go see him soon to get my motor swap legal and inspected. I'll ask him about it then, and post up what he says...
