I prefer stock flares.

4.5in on 35x12.50

No it's not, that only applies to commercial vehicles. Passenger cars don't even have to run fenders here legally.

I would prefer stock too, but then I would have to severely limit my flex. This is why I want to make metal flares, so I can cut the fenders as much as I need.

I also like the stock flares but mine is already in bad shape. Instead of repairing them, I’m planning to buy a new set, and thinking of getting the Bushwacker. Though I can’t decide which among these styles - http://4wheelonline.com/Bushwacker_Fender_Flares.3170 should I get. I’m torn between the cut-out and flat style. For an average wheeler, what can you recommend? And what can you say about their quality? I just want to be certain that this fender flare will not fade or flake easily.

Wrong. It is illegal. Are you a state inspector? I am, and I have failed vehicles for this. And I correct myself on allowance, it is 4in which would still fail a XJ with 4in backspace and a 12.50 tire.

§ 46.2-1017:
All motor vehicles, trailers, or semitrailers exceeding seven feet in width or the widest portion of which extends four inches beyond the front fender extremes shall be equipped with amber lights mounted at the extreme right and left front top corners of such vehicle. Each such light shall be visible in clear weather for a distance of at least 500 feet to the front of such vehicle.

Your XJ has no flares nor marker lamps on fenders and therefore is illegal.

I am and that has nothing to do with tire coverage requirements and it's not part of the state inspection procedure. It merely says you have to have marker lights above whatever sticks out more than 4 inches from the furthest point out on your front fenders. Marker lights aren't flares or fenders and you can comply with that law without having either. Hell, it doesn't even say anything about your tires, it simply says whatever sticks out more than 4" from the outermost point on your front fenders. That could be anything from tires to truck bed boxes to a flat bed. At worst it's a fix it ticket and you're not supposed to be failing people over it because it's not an inspection requirement.

There are only two vehicle laws in VA regarding fenders, the one you posted and the 2" requirement for tires that only applies to commercial, not passenger vehicles. There is no law requiring passenger vehicles to have their tires covered in this state.

What you posted refers to marker light requirements, not fender or tire coverage. That's what that entire section of the code deals with. "Dimension or marker lights and reflectors, generally"

The point in the law is so that parts of your vehicle that stick out are visible at night.
