Most of this land is trust land which is not to be sold for development and if it is, it is public domain which would mean Rio West is listed as the land owner publicly which it is not listed. any private company owning any of the land can not do it via a piece of paper blocking us from said public land. That is why State Land Trust the BLM and forest are all investigating this guy because he can't block us from there. This is also a fence out state which is the only legal to stop access. I'll stay on top of this, they are calling back later today.

I do not doubt that this company has some ownership of land out there, though exactly what the boundaries are is a mystery to me as yet. They have, for the last 6 months, erected fences as well as "no trespassing" signs. They have all been removed by people that think they have a right to be out there. This puts the company between a rock and a hard place. Their signage is being destroyed, as well as their fences.


We, as responsible 2 and 4 wheel recreationists need to respect the wishes of land owners. We have some bad apples that have not shown that respect, and is creating a larger problem.


Until the exact boundaries are clear to me, I will not be taking a chance. As a life long recreationist, it is my duty to know where I am wheeling, and if it is legal. I will wait and see. As I understand it now, the main wash is not available for my use, not the "air down" and associated areas. Some areas accessed from the south "may" be available. But I am not sure. There are several people in touch with the "owners", as well as the state. Better to wait and see how that shakes out, rather than stir the pot, IMHO.


You can say it is a fence in/fence out state. They will say they have been trying to do just that, but it keeps getting torn out. As far as I am concerned, I know they do not want us on their property... so that is good enough for me until I know exactly how to access trust/blm, etc... land without going where they do not want me to go. I do not want to get in a position where they have to start making examples out of people.


I also understand that they may be willing to open a "pay to play" area on their part of the property in the future, so that offers a glimmer of hope.

i agree id rather just go wheelin somewhere where there are no serious questions of legal use.... once everyone is ready to go out lets go somewhere new, welll new to me any ideas, prolly wont be till after the 1st i would guess????

 

I've also wanted to try the trails on the outskirts of santa fe its just a drive and a half. You could wheel in the mesa too but its not the same .

 

Yeah after the 1st for somewhere new. I might go up there in a month and see what they're doing to enforce this.

 

The flyer is in no way a legit means of communicating that the area is closed. If found on private land thank the guy for their time and exit the area. Only when it is clearly marked and posted at all possible points of access can the land owner or government truly enforce such restrictions. This includes BLM and Wilderness areas.

I have been caught riding my bike in wilderness area up near Cuba. Area was not marked or had any signs and was not enforceable from the trail access point I took. Signs up near Cuba for the wilderness or posted flyers near where I exited restricted anything with a wheel from access which is illegal but that will get us off topic.

Per the information thus far I would say Rio Puerco is open for wheeling. Be responsible and there should be no issues. Until such time the area is clearly marked with official BLM signage then I would feel comfortable using the area.

A flyer with an individual clearly marked with contact in PHX has no jurisdiction here in NM. If it was privately sold then it is his responsibility to mark the area officially or he can not claim or enforce trespassing.

A similar tactic was tried a while back by the tribe out near White Mesa restricting access on Cabazon road through their land. BLM put a stop to it right quick as it is an existing road. My understanding is one can drive from Southern out to Cabazon by some means legally is the rancher gates are open from former co-workers. Speaking of former co-workers I'm seeking new challenges / employment coming from an project management / engineering / aerospace background.

I have not contacted them yet as there are a bunch of things that I need to buy for my jeep before lighting. If there were enough locals to do it soon, I'd pursue it sooner than later though. A group buy with people from out of town would be a headache considering the extra shipping.

 

im hearing that the owner(Chuck Warner who owns that 12,000 acres) of this land has plans and paperwork in order to keep open part of the land for offroad use as he is apparently an offroad enthusiast... The problem is whoever these morons are that keep tearing the fences down and destroying equipment around where they plan on putting these wells.... apparetnly if vandalism wasnt such a big concern he wouldnt be making such a big deal out of this.... so thank you irresponsible selfish vandalists who cant control yourselves now we have to wait for this to all get worked out

 

Where did you hear that. With my work every site we have is vandalized. I agree people need to stop tearing down fences. But unless they actually put efort into in it wont stop. Some people in my office have paid thousands to put up 8ft fences around out equipment, and still we always find are crap shot up. People love hitting our solar panels
