Thumbs down Wrecked my Jeep...

Got rear ended last night on the freeway, and got pushed into a truck in front of me. Cracked my hatch in like 4 places, blew my rear window out, smashed my front and rear bumper, broke a taillight, broke my grill, header panel, headlight bezels, one headlight and crunched one front fender..and cracked my radiator. And the fan and pulleys have about a 1/4" of clearance between them and the radiator. Im waitin for my insurance company to get back to me to come look at it. To people who have had similar damage, did you get totaled out and if so, get any money back?

IANAL

You have liability? What will likely happen is either the guy's insurance company will fix only the damage in the back or total out the vehicle and try to give blue book value they list. Your insurance company is going to have to fix the truck you hit. If you only have liability you will be responsible for the front end damage to your Jeep.

Sucks about your wreck... Hope you didn't get hurt. That said don't be in a huge rush to settle and don't sign anything yet. If you got hurt and it shows up later you won't be able to get compensated for it.

Hope everyone was OK. This all depends on the state, insurance company, insurance coverage, etc. Same exact thing happened to us with my S10 and we ended up keeping the vehicle and getting a check for full BB value. $400 worth of parts later (JC Whitney is great!) the truck looked better than before the accident and I had $2K in the bank. It was a sweet deal.

This also happened to my wife in Mass MANY years ago and she got worked over hard. Ended up having to PAY because her vehicle wasnt worth what the vehicle she hit was worth. Good luck, youll need it. More than likely theyll try to screw you over. After all, it is insurance.

Yeah I'm alright, i was by myself so no passengers. My neck and back hurt like a ***** today though.

The front end is way worse off than the rear, from what i can see. I feel like the unibody might be screwed though since my driver door doesnt wanna close correctly.

You'd think that since its the lady who hit me's fault her insurance would cover all damage but yeah youre right its an insurance company so ill probably get screwed.

What I would do is make sure her insurance company knows you are hurt. Don't sign anything until you talk to a good lawyer. Insurance companies will try to offer you a crap settlement in order to try to sucker you into signing a waiver.

Sorry to hear that hope everyone us well . Pay close attention to the police report and how they report who's at fault ,that plays a big roll in who pays . I once got in an accident where I totaled Nissan altama that was in the oncoming lane .I was tring to avoid someone that ran a stop sign and I spun around and hit him in the drivers side with my front end. Even thou I didn't hit the guy that ran the stop sign and he left the seen the police reported him at fault . Hopefully It's going to be reported favorably for you

Sorry to hear that. Get legal council, have receipts for any extras you added, get checked out ASAP, argue with them about the value. We were in an accident a while back in my fiance's 96 Prelude. Girl in a lifted Explorer hit us broadside @ 65, knocked us 800 ft into a spin. We argued with the insurance agency and got $5K for the car and kept it (for parts to build another, as she bought it new and was just depressed as hell). Also paid all insurance bills and pain/suffering. We were not out to screw anyone, but if you're inexperienced, going that fast on ice and do something stupid to someone, you need to pay.

Why are people so sue happy? It was an accident and as long as insurance gets you money for your vehicle then all is well. The XJ is probably totaled cause they like to crumble upon impact.

Yea they probably will total it. For a body shop to get all those parts ,matirials and labor, very expensive ,total it then buy it back.

Dude, glad you are alive and well.

I got rear ended years ago with a van full of kids.(kids all okay).

Both my wife and I got whiplash (or worse) but never went to the hospital nor pursued any type of action against the guy/ guy's that rear ended us.
My neck was stiff and "sticking" on the scene when I turned my head to the side but I had to be billy bad-*** and said I'm okay to the paramedics that showed up.

We both now have chronic neck problems since this happened about 7 years ago.

My advice is to get checked out by a reputable doctor and document everything so if you do see a lawyer you are legit.

The guy that hit us was actually driving a mildly lifted XJ jeep not paying attention flying down a hill and smashed into the back of a Volvo that in turn smashed into us because some numb nut two cars in front of me decided to do a last minute turn.
Luckily I never tailgate otherwise I would have hit the guy in front of me which I just escaped from doing had I not been four car lengths behind.

There was a beautiful lady in the pass ft seat of the Volvo that had her feet up on the dash at time of impact and the air bag messed her legs up bad-I think she broke both legs.

Messed up the Volvo a decent amount and dovetailed the whole back half of my Astro-van since I had a trailer hitch mounted it bent it from the frame to the roof.

Surprisingly the Jeep barely looked damaged at all and was still running after impact.
I told the guy to shut it down just in case of a fuel leak.

I know a family friend who is an insurance lawyer so I'll talk to him. On the police report it lists her as following too closely but im not sure if he listed me as doing the same. When I talk to my ins. company I'll see what they think. My neck is really killin me I'll probably end up getting it looked at.

We didn't sue the chick or her insurance company. We spoke to an atty for advice - no need to have him suck up excess funds. He gave us guidelines to go by and they worked. The problems came when they tried to lowball us on the car - medical bills are a no-brainer.

Unfortunately, what these Jeeps book for and what their "real world" value is are 2 different things. My '88 YJ has as much real world value as a '95 YJ, especially with the mods we've done, but total it? I will be lucky to get $3K for it. Not nearly enough to replace it. Same with our XJ's. These get fewer and fewer every day, get more and more popular every day, yet the book value slowly goes away.

Try to do as others have suggested - let them total it, and buy it back cheaply.
