Oh GAWD! Guys, enough with "the law". Every car must have one, period. If you dont run one, fine, keep it in the bedroom along with your sexual orientation, political orientations and religion.
Now, on the "certification" of a cat being bad or w/e... I think it is pretty conclusive that a non-existing catalitic converter is CLEARLY a non-functioning catalitic converter, therefore, just get that damn thing installed. NO ONE is seriously going to crawl under your rig, check the welds, do carbon-14 testing on the cat and make sure that it is the stock one.
To conclude my drunken tirade, just have one, if you dont; lie.

No need to be an ***, honestly. I may be "new" to this forum, but I am not new to forums. Hell, I am a moderator on a world wide Ranger based vehicle forum.
I can even admit when I am wrong. I just read some of the Clean Air Act and it does say it is prohibited by even vehicle owners. However, I can see by the language where it can be understood to not include owners taking them off.
The Clean Air Act also says it is illegal for non-certified individuals to install them. That means if you buy a high flow cat, have welding/fab skills, and plan on putting it on yourself it is also illegal.
The CAA also says that no catalytic converter shall be removed for any reason unless it is deemed inoperable by a certified technician. That means if you have a performance car and plan on replacing the stock converter, your stock converter must have a problem and it must be replaced with a stock unit. The CAA also states that the stock converter must be covered by the vehicle manufacture for 8 years or 80,000 mile warranty.
The CAA also says that if a vehicle is an off road vehicle, it doesn't have to have one. That doesn't make sense since off road vehicles "pollute" the same air as on road vehicles. That is the government for ya, no common sense.
Honestly, my vehicle will not have one put back on it. I am not going to spend the $100 to put one on it when we don't have emissions testing here and my vehicle will mostly see off road.

In the Peoples Republik Of Marylandistan ( Maryland ) every county has a Smog Facility.
A vehicle is require to be tested every two years, but what sucks is in reality a vehicle could require testing evey 90 days in theory.
Anytime a vehicle is sold, a new test is required withing 60-90 days of transfer.
If the previous owner had my XJ tested before I bought it, the state will still require another test within 90 days ... at my expense of course.

And I thought I disliked Maryland just because of Baltimore... now another reason not to like Maryland

If Maine was 'motorcycle friendly' they might be OK but I have seen some of the motorcycle related legislation attempts up there, One of which was to adopt an EPA policy as law, I think.
My other riding passion is motorcycling.
Yeah Baltimore's roads seem to be in the same condition as I-83 north of Maryland! 
We're leaving Maryland in a two years, but we will be heading south I believe. Motorcyclists are coming under attack in many states, thanks to the EPA. If the EPA puts marking requirements on CATS as they do on Motorcycle exhausts all this talk will be moot.

My XJ not having one does not make people who wheel like like "total ********". The CAA says that off road vehicles don't have to have them, so since my XJ is an off road vehicle, it doesn't have to have one.

In regards to EPA and DOT off-highway/off-road use only usually refers to vehicles that are only used in car shows and at the race track. Places vehicles do not have to have a title or registration and will be "trailered" to the event.
Personally I don't care what people do they are the ones who have to face the music when the time comes.
And you can reprogram the ECM/PCM and delete the code for the downstream cat so it will never trip the check engine light.
It's a common fix for those who run a high flow cat.

Besides, now that most parks are private parks the environmentalist have not say on what goes on there.
I suppose those who are playing the "it's illegal" card never do anything illegal. They never speed, never drive without a seat belt, didn't drink alcohol before the age of 21, never jaywalked, never ran more than 55w of forward facing lights on their vehicle while driving on a public road, never had a vehicle that violated their states lift laws, etc.
I sure am glad you are perfect and are high and mighty.
Anyone else now find this a directionless discussion? The poster got the info he needed. The law on cats has been posted- it's up to the individual to abide by it or not. Some do and some don't. Just like every other law.
This conversation hurts my brain even when sober...
