Now.. Is the fluid burnt??(black,stinky).. or just very worn(brown, dirty)?

There have been issues when flushing AW-4's that have been running on burnt tranny fluid. If it is burnt, drop the pan, change the filter, refill with whatever Dex III you get and keep on trucking. Realize that you are probably on borrowed time in this situation.

If it is dirty and worn, this becomes a bit more of complicated answer. Normally a flush would not hurt the transmission, but if you do not know its service history. You cannot rely on it not becoming an issue.
The TSB is dealing with the properties of the new DexIII fluid that should apply to all units, I have seen DexIII do the same thing in other manufacturers units.

Dex III is basicly a thinner version of DexII that they developed for colder areas.

Drain the fluid in the pan (between 3-4 quarts)

Use Dex/Merc III compatible.

Be sure not to overfill!

No way would I leave dirty burnt fluid in any vehicle I work on .......but I agree I'm not a big fan on flushing ESPECIALLY if the tranny hasn't had frequent fluid changes.

So no filter change? My fluid looks pretty good, but I don't have the maint. records. How's about Mobil 1 ATF?

The filter in the AW4 is basically a screen. I replaced mine once around 90k and it wasn't dirty and as I change fluid frequently, I haven't pulled the pan to check or replace it again.

But if you have unknown maintenance history, it would be a good idea to take a look.

We are referring to two different TSB's then. The one I am referring to is from Chrysler and is dated Apr 08. They removed the Dex III only criteria for AW-4 service, lumping it in with Chrysler trannies receiving ATF+4. The issue other than ATF+4 being the wrong fluid, is the timing. Chrysler issued a TSB in Oct. 07, specifically exempting the AW-4 from ATF+4 recommendation.

The timing of it is very suspect. Apr 08 would be as the last few thousand AW-4's would be exiting extended 7/70 warranty coverage for owners that purchased '01 models. Most times a Dex III/ATF+4 discussion comes up, certain members of this forum howl and moan about how Chrysler updated the recommendation for the AW-4. But can never produce one shred of evidence that Aisin-Warner or Toyota ever said that the AW-4 should be run with anything other than Dex II/III.
