ugh... so much debate on all this. its such a preference thing. as long as you have the proper BS and all, then its really more about how hard your going to be wheeling. bigger stronger axles are gonna naturally push out the wheels, but im not a big fan of all that extra tire sticking out. the local po are very stick about this, so thats an issue. you gotta d so much more work to accomplish the same clearance. i recently was reading up on the +/- of bigger tires and suffice to say, going from a 33 to a 37 isnt that huge of an advantage. you add a lot of extra rotating weight and there is some increased ground clearance, but not too much... i think the width of the tire is just as important as anything else. make sure that you have picked the right tire for you! if your gonna do primarily one type of terrain, then get a more specific tire. idk, just my .02

It sounds outrageous but the laws in Illinois and Colorado states if you have them there unsafe but I also have found that the laws state if you were ever in a car chase that they couldn't ever shoot your tires out because you bead will stay on the wheel and you could keep on going for a while longer.
This is just what I have heard and read but haven't seen any evidence of these laws.
