Previous owners couldve had something to do with that.
e.g. PO couldve swapped it into another Jeep, and put his the D35 underneathe that one.
Or it could come down to, what month it was built in the factory.
But I'm putting my money on the first one, from a PO doing something.

Maybe I jumped the gun on saying he flat out lied....I guess it's possible there was a mixup and the guy made an honest mistake...
Problem is...It seems with lots of businesses.... "honest mistakes" are starting to become the norm instead of the exception....
I've had problems with getting the wrong stuff, broken stuff...and not just when it comes to vehicles.... and being told...."no problem, just bring it back"....Well it IS a "problem"...I didn't get what I friggin wanted/expected....and now have to waste more time to take it back to get what I wanted....if they really even HAVE the good/right one...Meanwhile dumbo at the counter hasn't moved since I was last there....So of course....to him....it wasn't a problem at all.....

Your ranting over your own stupidity in not checking the part on the scene before leaving with it.
I see a 50/50 problem there, 50% the yards for not doing the basics, and 50% yours for having your head up your **** and not doing the basics.
Be glad you can return it and move on.

Sorry to derail, but was there any rhyme or reason as to what got an 8.25, and what got a D35? I have a 98 Sport w/out a tow package or anything, and it has an 8.25. I have a friend with a 98 Sport w/out a tow package that has a D35. I just don't get why models from the same powertrain/trim package got different rearends.
The years are a little unclear to me because I used to think that the 8.25 rear started with 96 XJ, but I know now that there are some several years older.

Firstly,
drums typically don't rust up on a recently pulled parts.
If this is the case, that is the first red flag, and yes if they was rusted on I would have even more so demanded the cover be pulled for an inspection.
Least you could have done was come here and ask for a few tips. There would've been 50 replies giving you the advice needed to check the differential for issues. Not come on here and moan about stuff.
Maybe the yard did have an honest mistake and their nephew that pulls parts grabbed a core rear end, but still in all things used.
Caveat Emptor .
