That looks like a solid jeep The 35 wont bother you too much unless you go crazy with tire size...guys on here forget TJ guys run em on 33's ect. I see a rubicon express sticker too so maybe this guy took care of it.

to tell which rear end is in it, you gotta look underneath it... both the Dana 35 and chrysler 8.25 rear ends have a differential cover that looks like an oval, but the chrysler 8.25 has like a flat block on the bottom of the housing itself... there's threads around here with pics if you do a search that'll help you tell the difference. Stock my 97 gets about 20 mpg on the highway... but once I get the lift on it and bigger tires I imagine that'll go down a bit. I don't know what year they started putting cupholders in them, lol, but I'm sure someone here does. Also, I think the NP231 is the better transfer case for offroading, not sure if that's the general concensus or not. I would definately prefer the 4.0 HO over the older 4.0 renix engines too. not only for the better power output, but for the open cooling system. The renix cooling systems were sealed and had to be burped when you change out the coolant.
If anyone wants it i have a 98 xj for sale with 4" of lift on 31s with the clean fender cut ive ever seen
