Rear-ended by an uninsured motorist. Need some help.

I was rear ended by a lady with no insurance. My insurance company (state farm) sent an adjuster who had the misfortune of having his head stuck up his ***.

The small crumple that was left in my left rear quarter 'couldn't have happened from this accident'. Per this guy. If you're familiar with the 99-01's, the bumpers have black end caps that are held to the quarters with three clips. The cap was folded RIGHT AT THE FOLD in the quarter panel. No matter how I explained it to this guy, he couldn't see how this would have led to this damage. I'll get two new caps, a re-painted bumper, and a straightened frame, but the panel will not be touched.

I was hoping one of you has had a similar accident and has pics. I would love to show them to my agent.

The $ check that they want to send me is for $640. About a grand shy of what I should be getting.

And I was hit by a hybrid..... by a lady who was texting.... into a blinding sunrise... who appears to not have her citizen status where it should be....

Sorry to hear,
I got rearended in my 96 ZJ, dum Bi#^H said I backed into her..... when ever I have insurance problems I just to 2 or 3 body shops, get an estimate, & hand it over to my insurance company. They might give you a bit more than they first offer. It's just like buying a car.... low ball them first & then negotiate....

You need to go get a second opinion. Or show pictures b4 the accident. Have the other shop state that the 1/4 panel was damaged by the accident.

I got rear ended in my gfs 98 chevy cavalier they said it was totaled, i negotiated with them got 3500$ then bought the car back from them for 300$. Replaced the bumper and trunk lid. Still driving it.

Have you made any attempt to collect from the driver?

Agreed take it to a few different shops and have them give their opion on how the damage was a result of the accident and take that to the insurance company do not let the agent that came out be the call of how the damage occurred he is an insurance agent not a collison expert.

OP says an adjuster gave him his estimate. Agents don't adjust claims, at least for the major insurance companies.

Are the figures you quoted above net of your deductible?

Agree with getting several estimates from reputable shops.

Were the cops called and did the other driver have a license?

If you take it to the shop of your choice and have them fix it they will be able to leverage the money required to fix it better than u because they can say this was damaged and the adjuster didn't notice it and insurance should cover it. Hope this helps

Hey sorry to hear about your Day. I agree with you. any time the rear is hit, the Q. P. will be effected. any Pic's that you can Post. I'M a Independent Insurance Broker. First thought was call your Agent. He does not want you to not be Happy and walk away from his agency. I agree with everyone about getting est. from other shops. State Farm has a good rep. for takeing care of there clients, Maybe the adjuster is new of got up on the wrong side of the bed. lol.. BTW. i'm not a State Farm Agent. Again call your agent Thats his Job the be your go to Guy..

Contact your lawyer and take her to small claims for the remaining balance of the damages, and the fees associated with going to court. It's a crappy way to get the money needed to repair your jeep, BUT if you really want the panel straightened without paying out of your pocket it may be the only other way to go. You've got what seems to be a decent case against her... No insurance, and texting while driving, and hitting someone from behind is an automatic at fault for that driver (at least it is here)

It sucks but this is more common now days with the crappy economy. I’m an adjuster (not for St Farm) and though I handle bodily injury claims I know and deal with the property damage side as well. At this point with the company having already written an estimate your option is. Take it to a shop that you plan on doing the repairs and have them submit a supplement for the additional damage. You can always call the claims adjuster (or team since its St Farm) that is handling your claim and ask for a manager and pled your case about the missed damage. If it was me I would take it to my shop of choice and have them start repairs and then send in the supplement. Hope this helps, St Farm is pretty decent to work with most of the time so I’m sure they will come around.

Your adjustor acknowledged the frame damage right?

Ask him how the frame damage DIDNT cause the wrinkled rear quarter.

He's just trying to save the CO money.. go over his head.
