Engine Code P0740 diagnosis

I just got a new 1999 XJ about a month ago. I now have a check engine light that has been intermittent. The code is p0740 which has been described a few different ways Torque Converter Clutch(TCC) Solenoid, TCC Solenoid stuck open, and TCC open circuit. It was shifting smoothly until a few days ago when MI went from nice and warm and in the 40's to in the teens and single digits. Now if it not all the way warm (at least 110 degrees) it slips a bit when moving from a stop but only does it once or twice then drives fine. i'm trying to drive it as little as possible till I can figure out how to fix it.
What could it be and how can i rule things out.
I've herd it can be one or all of the solenoids, fluid dirty or over or under full, speed sensor among other things (such as a whole new trans (ouch)
In addition the TC seems to be locking up
Also, in the case that it is needing a new trans or an expensive fix (I'm a broke college student about to graduate in may) I do have a 96 xj at home that needs some motor work so I planed on making it a bigger toy once I find a job. Would I be able to swap the transmissions from the 96-99.

You are correct in possible causes. So with any issue, you need to start the "process of elimination".
1. Be sure fluid is RED. Be sure fluid is at the correct LEVEL. Be sure fluid does not smell BURNT. Do not proceed until these conditions are met.
2. Test solenoids for resistance located inside of the transmission pan
Plenty of time to ponder more complex issues after you've tackled items 1 and 2 above.
