I would assume manual, but an auto could do it too if the linkage is messed up...
If manual, it shouldn't be falling out of gear. There are detents to hold the shift shaft in place, and the synchro hubs themselves are designed to hold in gear. The detents would have to be damaged or gone and the synchro teeth are probably worn out. In a perfect world, the detents should hold it in gear even with a worn out synchro.
Does this happen in every gear? Just one or a few? Your transmission may need a rebuild. In many manual transmssions, a badly worn input shaft bearing can cause 1st gear to pop out.

I don't know if this pertains to your problem, but when I lifted my Wrangler it would pop outr of 3rd gear. I talked to the shop owner where I bought my lift, which they also install them. He said that the shift boot was causing it to jump out of gear. After the lift and transfer case drop, it put the shifter lower/ at an angle in the boot. So if you have installed a lift and transfer case drop, this may be the same issue that I was having. It eventually wore in and I haven't had any more issues.

well ive tried to put it in 3 or second and go a constant sppeed but it wont fall out its random when it does it but that was my guess im not all to good with auto trannys only good with manual trannys.....though that was gonna end up as my conclusion was a solenoid i guesss the next step is to get the multimeter and try to find continuity if i cant find any that might be the issue
