Paypal dispute filed.
Justin i will not accept a partial refund considering the fact i advised you the part was missing PRIOR to you shipping the package and me sending payment. That was the whole point of the picture request.
You acknowledged this fact when you stated the part was almost out of the vehicle.. then i made payment.
Dont go thinking you can ignore me now.. i do have options here. You need to continue communication and send me my full refund. You can have your damaged and incomplete kit back..

You going to respond to this or the paypal dispute? I see you have checked in here a few times today, but you dont have the ***** to respond?
Innocent men dont hide.. tomorrow i start posting the PM's and emails we exchanged so others can see what has transpired here.
Explain to others here your reasoning for wanting to keep part of my payment for your screwup...

I PM'd this gent when he mentioned the potential to scrap this vehicle. I expressed interest in purchasing the 5 speed specific parts. He replied telling me he would keep me in mind.
Awhile later i inquired again after seeing him bumping the ad and still not having a buyer. He said he'd let me know as he had a guy showing interest.
Around this point i started losing interest in the parts after seeing the issues of doing this on an OBDII vehicle and the inherant CEL. Apparently his buyer fell through and he mentioned pulling the parts... now i felt obligated to follow through with the purchase. We negotiated a price plus shipping.
I asked for pics of the parts as removed. He sent a pic showing the ECU, Shifter and upper boot, the shifter indicator and the clutch pedal. I responded telling him i also needed the brake pedal as it's different from the auto version, and would like the inner shift boot as well. He responded saying the brake pedal was almost out of the vehicle and the inner boot was trashed. So i paid him.. and asked for a tracking number once shipped.
Few days later i again asked for the tracking number. He replied with it showing it had shipped that day.. yes it was shipped in a reasonable time of a few days.
Once i received the package and opened it i found the brake pedal assembly missing... even though i told him prior to shipping and payment that it was needed to complete the swap kit. I also found the outer shift boot had a good size tear in it that he hadnt mentioned. Also found that the indicator for shifter was missing although it was in the pic.
Emailed and posted here that there was a problem. He responded with his phone number. I called Justin. We had a civil conversation and i explained to him i needed the other pedal or the parts i received were worthless to me. I also mentioned the damaged boot and missing indicator.. but mentioned i wasnt as concerned as much as i was about the pedal. Told him he either needed to ship me the pedal or refund my purchase in it's entirety.. and pay for the shipping to return these parts to him. He told me he would think about it and call me back that night or next day. I made a point to tell him i expected a call that evening.
During the call he did make a comment where he felt i was trying to get more parts after the initial agreement on price.. i explained that wasnt the case and that the brake pedal was part of the assembly. One is useless without the other.
A few hours later i guess it was i had become less than confident with this whole mess. It didnt feel right.. i emailed asking if he would just refund my money and we can ship these parts back. It wasnt my fault he forgot or didnt feel like shipping the pedal. He knew it didnt go with the rest of the parts, what did he think would happen once i received it?
He made an offer of a partial refund.. about 2/3 the total and told me to keep the parts. Again i told him the parts are worthless without the other missing parts. I again requested he ship the pedal or issue a refund. I actually asked this time if the Jeep was scrapped yet.
He replies that the Jeep is gone. He says he will refund all but $40 for the shipping charge. What.. I Payed for shipping. (He charged me $56 for shipping and said "round it up to 60") Yes i realize he hit me heavy.
I advised him he owed me a full refund. He started ignoring me at this point. Which led to these posts and my opening a paypal dispute.
I dont understand his logic for thinking i'd agree to a partial refund... he didnt pay for shipping. Why should i be out of pocket for his screwup while he still profits? I dont want these parts without the rest of it.. they are his and i'll ship them AT ACTUAL COST when he pays me to do so after a full refund. He can then sell the incomplete kit if he chooses.
So Justin, care to dispute any of this? I'm an honest man and have bought and sold Jeep parts for the last 15+ years. Never had a major problem till now. Man up and make this right..
To be honest i feel you intentionally figured to screw me once you shipped the package knowing full well that i had expected and paid for the brake pedal assembly.

Pedal assembly and shifter with boot. Maybe the ECU as well. Let me know if you decide to part.
John
..........
As your first and every other message says "pedal assembly" you never mentioned assemblies or pedals. You mentioned the brake after our initial agreement. So I still don't believe I owe you anything I made a fair arrangement to give you the parts for the shipping only since I did tell you It was almost out and it obviously wasnt
...........
OK, so you admit that i inquired about the brake pedal before payment and shipping right? Why would you not attempt to renegotiate price or tell me it's not coming in the package and just take my money?
Again.. explain why you get to keep part of my payment!
I'll admit to possibly being vague on HOW MANY pedals constitute an ASSEMBLY. To be honest i wasnt originally aware that the pedals were actually TWO SEPERATE PIECES. You still replied that i would in fact receive them when i made you aware that i did need them to complete the swap kit. I did so after you sent the pic.. that was the whole purpose of the pic.
Let me ask... did the Jeep get scrapped before you shipped the parts and prior to me asking for the brake pedal? That would have been the time to make me aware of that fact and i could have told you i was out of the deal. Instead you took my money knowing i wasnt getting a piece i NEEDED to complete this.
Thats the part that PO's me the most... you just wanted my money... even if you had to deceive me to get it.
Have the ***** to continue this discussion in public, i have nothing to hide. I'm escallating the paypal dispute to a claim now.

Wife just reminded me i had a heart condition after seeing me all pissed off.. she's right when she says your not worth the agrivation.
Send me back the money you offered and i'll drop the paypal dispute. I'll eat the third of my payment and chalk it up to a lesson learned. I'll need an email or text asap with whether or not your still willing to do this.
You younger generation sure have a fukked up way of seeing things.

So in an effort to speed this up i decided to accept the partial payment from Justin of $95 which is roughly 2/3 the original purchase price including the shipping. I waited the week as he said he would send it friday.
Friday came and went with no payment. Texted him this am and he claims to not have worked last week and therefor can not pay me. I asked what now... he responded for me to close the dispute and he will send me the money. I wasnt born yesterday and realize if i close dispute i have no avenue left to recoup my funds. Then he said... "I hope your a patient Man"..
I have no doubts he's looking to screw me by making excuses to keep time clicking away on dispute or get me to drop it entirely.
I escalated this dispute to a claim this am. Paypal can now give me my money in full, no more partial refund for his screwup. He can pay me to ship his parts back too..
Dont deal with Justin Foster of Slatington Louisiana.
MODS... can i get an IP check just to rule out this isnt "you know who"...

Here is the string of emails that proves my claims. You can clearly see that once i received the pic i advised him the brake pedal was needed as part of the assembly and his responce that it was almost removed.
I edited some of my personal info.

You charged me $56 shipping and rounded it up to 60.... not $40. Use that extra 20 to ship the pedal..
I knew that shipping charge was very high but i felt commited to completing the deal after you said you removed the parts.
I'll need a response either way tonight. Either your shipping the pedal or refunding my purchase in full, you can also pay to ship these parts back to you.
