Thanks A LOT for your input on this. How much does your insurance run? And as stated, I would keep the "Jokers" off the property to avoid issues(as much as possible). And thanks for all the positive responses guys!

Here it all had to do with acre size. 60 acres was $12,000 for the year. It was ridiculous.

as to keeping the jokers out. you can be the nicest guy in the world and get your rig in a bad situation where it flops or rolls. can happen on any real trail. he can sue you. sitting there with a lawyer and hearing this pissed me off

It's a real shame that we are such a litigious culture, not being responsible for our actions, trying to blame someone else, and "wringing [our] bread from the sweat of other men's faces." It is to a point where you can't do an act of kindness because you have to be concerned that, with all the good intentions, something may go not as planned.

Does your family carry some sort of liability insurance on the property already? Certainly trespassers come and go all the time, and what if they trip on a tree root sticking out of the ground, fall, and break their arm?

If you were to only invite guests and not do business (i.e., charge to ride), would the current insurance be adequate coverage?

You could also ask "guests" to supply you with proof of their own automobile and health insurance or provide some other proof (I don't know what) that they are upstanding people and aren't the "sue you" type.

say a father of 4 is out wheeling. flops his rig and smashes his head. is helo out to the hospital and is out of work for 2 months to heal. of course you have to think of the family and not having $$ coming in. of course you would sue. would I do it? dont know and hope not to be put in that situation. i can see it both ways though.

liability insurance will not cover it. cant remember why though. had to do with vehicles on the property. if someone trip on a root in your property in washington that can sue you for negligent actions for not keeping up your property.

you could ask for guest to show auto insurance and health care. that only will get so far. with a major head injury you can spend more then what you health care will provide. so of course you will be sure for the remaining. same with auto, they will only pay to a certain percent. with so many out of work do you really want to only invite ones with health care? not their fault the dont have health care because economy sucks.

it sucks i know. thats why we canned the idea because we didnt want to be held responsible in any manner.

also if the DNR catches on that you are having vehicles on your land in a somewhat regular basis they will come and investigate to make sure no sediment erosion is going on. they WILL do this even though its private property.

and we wonder why places are being shut down? because you have to jump through so many hoops its ridiculous.
