Okay thanks for all of the help. I do still have some questions.. If the front shaft is always turning is it not in four wheel drive all of the time?

No. As the front wheels turn the axle shaft is turning, which also turns the ring gear, and the pinion gear, and the driveshaft. As stated earlier the tcase controls all the engagment of the 4wd. When it is in 2wd the gears inside the tcase are disengaged and the driveshaft is allowed to spin freely.

no, it is not in 4wd all the time. the t-case doesn't engage the front drive shaft and force the front wheels to turn in 2wd (you could still peel out the rear wheels without the front wheels or drive shaft moving at all). However, as long as your front wheels are moving, the front diff is turning your front drive shaft as well. It is being moved by the diff, not the t-case. When the t-case is engaged, it will force the front wheels to move with the back wheels. This design allows you to switch from 2wd to 4wd while the car is in motion, since the front drive shaft always turns at the same speed as the t-case as long as the front wheels are moving.

Ofcourse with the disconnect axle you could put a spool or a locker in the front axle for the ultimate offroad traction without having steering issues on the street.

Just swap out the front axle with the vac dico shift fork locked in, and enjoy your time on the trails. There is no need to swap the tcase.

For a future project, I have the 90 t case with the vacc on the back. Can i use this with another front axel and the 4x4 work or will i have to do something with the vac ports for the t cases to opperate properly...

You sure can. The vacuum stuff just controls the actuator on the front axle. With it eliminated, the the extra stuff is pretty much useless and has no function within the t-case. Just FYI, in I believe '91 (someone correct me if I'm wrong on the year) Jeep change the input splines on the t-case to 23 spline from 21. Obviously, the output on the trans changed as well. Looks like you may have a conflict between your parts vehicle and your rig if you were going to swap cases.
