d 30 wobbly pinion

i just bought a hp d30 on cl for 75 bucks complete from disc to disc with steering and the works looked to be in great shape but like i dumba$$ i didnt look at it very close and upon further inspection i come to find out the pinion is pretty sloppy i can pretty much wobble it around a little enough to where it binds up a little while turning it so im just wondering if this is fixable by tightening the nut in the yoke or changing a bearing without having to reset the gears if its all bad and would have to re set the ring and pinion ima call the guy back and demand my money back of course ive just never dealt with gears before

id check the gears to see if they are still good. if the pinion is wobbly then that means your pattern is going to be off causing bad wear on your ring gear. your going to have to re shim it anyways as a new bearing will change the pinion depth a few thousandths at least causing everything else inside to like back lash to change
