"Joel Ramer and his girlfriend got stuck off-roading this old Jeep Cherokee on a powerline road in Walpole, Massachusetts last week. Seems egregious that he was arrested for trespassing and disturbing the peace, but the $48,000 recovery charge is downright offensive." ...

Why even call for a tow off road most towing companies won't leave the black top.I would have called a friend with a truck and bring a chain or strap to pull me out.A case of beer is a lot cheaper then 48k.
There is something important all offroaders should know about this situation. I have been through this and what I found was that legally and Constitutionally, no private property owner can deny "Reasonable access" through or over their property if it is the "only access" available to where one wants to travel. I have been on the other side of this as a property owner several times. "No trespassing" does not apply if it is the "only access" to where they want to travel.

The link is broken so I assume someone was trespassing and got stuck, called a tow truck and got slapped with a big bill? most tow companies make you pay before they release your vehicle.
Well drunk of course would be different. This would be a completely separate crime in it's self. Seriously though...I have had the law out to arrest folks for trespassing over my private property many times only to be told that because it was the only access to where they wanted to go it was a civil matter and they could not get involved. As a civil matter I then have the burden of proof in proving an injury.
I have also in turn used this legal fact myself without any opposition or argument when stopped on railroad, powerline, pipeline and BLM land right of ways for many years now. It does however release the property owner legally from any liabilities that might happen while they are crossing the property.

This only applies or is justified if it is the "only access" to where you want to go.

I not sure how the tow company broke the rear leaf and almost bend the jeep in half. Not only that, it took them 12 hours. They were wearing hazmat suits too. Lol
