Default Transmission/Clunk Issues

Just picked up a 2000 Grand Cherokee 4.0 4WD. I'm have 2 issues with it so far and I am looking for some help.

1) Transmission seems to be in limp mode. It takes off from what seems to be 3rd. 1st, 2nd, and Reverse all work as they should. Also, I want to add that if I pull the battery it will take off in 1st, but after the first stop it will go back to taking off in 3rd. It is not throwing any codes.

2) I have a clunk in the rear. At almost a complete stop it has a thud coming from the rear. I have greased the joint in the driveshaft. I will also say that when it is on the ground you can rotate the tire back and forth and see the axle twisting front to back.

Any help would be appreciated. I really don't want to have to do a full rebuild on the transmission. Thanks in advance!

Default Update: Help needed?

Had a local repair shop hook up to a scanner and they found no issues. The computer/scanner says it is going through the gears but they said clearly it is not. It will show taking off in 1st but it is clearly in 3rd.
